Under Statewide Planning Goal 18, Implementation Requirement #5, BPS may be permitted only where development existed on January 1, 1977. Development is defined as houses, commercial and industrial buildings, vacant subdivision lots which are physically improved through construction of streets AND provision of utilities to the lot, and where a Goal 18 development exception has already been approved. Status determinations delineated in the shapefile include: 1. Developed (therefore eligible for BPS permit under Goal 18); 2. Not developed (therefore not eligible for BPS permit); 4. Eligible under a prior Goal 18 exception; and 5. Lot is assumed to be undevelopable (most likely because that tax lot is completely or mostly within the intertidal beach area; check Comments field for additional information). &lt;/SPAN&gt;&lt;/P&gt;&lt;P&gt;&lt;SPAN&gt;A Goal 18 Status of 6 exists only for ocean front tax lots in Rockaway Beach. These lots are subject to a Goal 18 exception, but also subject to the City's ocean setback line, and so have to be reviewed on a case-by-case basis. Please see the City Planner in Rockaway Beach for specifics on the eligbility for these ocean front tax lots, &lt;/SPAN&gt;&lt;/P&gt;&lt;P&gt;&lt;SPAN&gt;This version of the dataset replaces an earlier version created in 2005. Note: The earlier dataset contained a Goal 18 Status of #3 Undetermined, which meant the eligibility status could not be determined, most likely because it would have required more time and effort to make a determination decision than could be afforded at that time. This designation is no longer applicable in the new (2014) dataset because every coastal tax lot now contains a clear eligibility designation as described above. This is why the G18 Status field contains non-consecutive numbers.&lt;/SPAN&gt;&lt;/P&gt;&lt;/DIV&gt;&lt;/DIV&gt;&lt;/DIV&gt;</idAbs>
<idPurp>This dataset was developed to provide local governments, state agencies, and the public with a comprehensive map of the Goal 18 Beachfront Protective Structure (BPS) eligibility status of oceanfront lots in Oregon. The dataset can be used in local government planning, state ocean shore planning, and general public outreach and information. It contains a catelog of coastal tax lots, which are given a preliminary eligibility status according to Statewide Planning Goal 18: Beaches and Dunes, Implementation Requirement #5: permits for beachfront protective structures shall be issued only where development existed on January 1, 1977. Local governments can use the GIS layer as a more efficient way to obtain information for customers, or when processing or providing land use compatibility determinations on State permit applications. Local governments can also officially adopt this GIS inventory in their local comprehensive plans so as to meet requirements outlined in Goal 18 Implementation Requirement #5. When reviewing permit applications, State and local governments will be able to use the mapping to identify potential conflict areas between eligible and non-eligible properties. The GIS eligibility layer can be used in combination with other layers such as dune and bluff hazard risk zone studies (Oregon Department of Geology) and the Beachfront Protection Structure database/GIS (Oregon Parks and Recreation Department) to determine areas of future BPS demand, areas of high risk development where BPS are prohibited, or unarmored shorelines where future beachfront protective structures could impact shoreline that is currently unaltered.</idPurp>

<stepDesc>Relevant data such as map and tax lot number, owner, year-built, improvement value, assessment records, survey and subdivision maps from all coastal County Tax Assessor's offices were used to inform eligibility determinations. Most of this information can be found online at the county's website. Digitized 1967 and 1977 USACE aerial photos were examined for the presence of structures or other signs of development. A Comments field gives the development (eligibility) status of the tax lot, as well as additional information about whether or not it is part of a subdivision, the name and date of the subdivision, comments from local government staff, whether a road and utilities existed to the lot, and/or other relevant information. A value is given in the Goal18 Status field corresponding to the following categories: 1) eligible for BPS; 2) not eligible for BPS; 4) eligible under prior Goal 18 exception; and 5) Lot assumed to be undevelopable (likely because the tax lot falls mostly or completely in the ocean shores area/ west of the statutory vegetation line; see Comments field for additional information); 6) Exists only for ocean front tax lots in Rockaway Beach. These lots are subject to a Goal 18 exception, but also subject to the City's ocean setback line, and so have to be reviewed on a case-by-case basis. Please see the City Planner in Rockaway Beach for specifics on the eligbility for these ocean front tax lots, These categories allow the tax lots to be mapped accordingly. Note: The earlier dataset contained a Goal 18 Status of #3 Undetermined, which meant the eligibility status could not be determined, most likely because it would have required more time and effort than could be afforded at that time. This designation is no longer applicable in the 2014 dataset because every coastal tax lot contains a clear eligibility designation as described above. This is why the G18 Status field contains non-consecutive numbers.
Important notes about the data: Subdivisions: If subdivision lot was vacant on 1977 aerial, but there were streets and surrounding houses, or houses nearby within subdivision, then assumption was made that utilities were present by 1/1/77. Determination of oceanfront tax lots: Oceanfront tax lots usually abut the beach; however, in certain instances, tax lots that were separated by public ownership, or were close enough to be at risk from erosion were included as oceanfront. In certain instances, if a tax lot was all or mostly within the ocean shores area, it was given a Goal 18 Status of "5" to ease visualization of the map (not visualize these lots) but still contains relevant notes about its eligibility in the Comments field. This was done at the request of local planners.
Accuracy of aerial photos: Historic aerial photos were sometimes of poor quality. Evidence disputing a determination made within the inventory should be presented to the local jurisdiction for further investigation.
General Use of Assessor's data: This database should not be used for obtaining up-to-date property record information. The assessor's office information was collected to make Goal 18 status determinations and is not updated regularly. Goal 18 exceptions: These were taken from city and county comprehensive plan descriptions for these areas. Particularly for those exceptions in the City of Rockaway Beach, please see the City Planner for additional details.
Streets, highways, and public access routes: These are not usually included in the GIS layer, as this is a tax lot-based project. (In some instances, roads immediately abutting the ocean were included for map visualization purposes.) Goal 18, Implementation Requirement 5 does not include roads and highways in the definition of development and these areas are generally not eligible to be protected by a beachfront protective structure. If a road tax lot was included, it was designated as ineligible for BPS. Year built date: If assessors' office data showed building date of 1977, assumption was made that the building existed on 1/1/77 due to lag time in County appraisal, and construction time. Also, if building was visible on 1977 USACE aerial, assumption was made that the building existed on 1/1/1977. However, if further evidence prooves otherwise, or the official subdivision plat shows that the approval was given on any date after January 1, 1977, those subdivision lots and/or developments are not eligible for BPS.
Large eligible parcels:
For Eligible Tax Lots that appear as though they could be further divided in the future, a note was included in the Comments field: "NOTE: if property is further divided after January 1, 1977 - any qualifying structure remaining or any structure in a similar footprint to the original qualifying structure continues to be eligible for BPS; however, newly divided lots are not eligible."</stepDesc>

<stepRat>The fact that the “development” is designated as eligible does not mean that a BPS can be placed automatically but simply means that the development is eligible to apply for a BPS permit and a BPS can be placed if the necessary permits can be obtained. The Oregon Parks and Recreation Department serves as the permitting authority for any alterations made on the ocean shores state recreation area (the area from extreme low water to the Statutory Vegetation line or line of actual vegetation, whichever is further landward). It should also be noted that the Oregon coast includes a variety of land forms including rocky shores and some areas include a mix of these landforms. To insure the analysis was comprehensive, a determination was made on all parcels along the coast. Where it is determined through site-specific evaluation that particular properties are not subject to Goal 18, the BPS eligibility designation for these properties contained in this inventory does not apply.</stepRat>
